1. Acceptance of Terms

By accessing or using Toonforge ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not access or use the Service. These Terms constitute a legally binding agreement between you and Toonforge. Your continued use of the Service following any modifications to these Terms constitutes your acceptance of such modifications.

2. Account Registration

To access certain features of the Service, you must create an account. By registering, you represent and warrant that:

• You are at least 13 years of age. If you are under 18, you represent that you have your parent or guardian's consent to use the Service.
• You will maintain only one account per person. Creating multiple accounts to circumvent restrictions, exploit promotions, or evade enforcement actions is prohibited.
• You are responsible for maintaining the confidentiality and security of your account credentials, including your password and any associated authentication methods.
• You are responsible for all activity that occurs under your account, whether or not you authorized such activity. You agree to notify us immediately of any unauthorized use of your account.
• We reserve the right to suspend or terminate accounts that violate these Terms, at our sole discretion and without prior notice where circumstances warrant immediate action.

3. The Service

Toonforge is a platform for creating AI-assisted novels and webcomics. The Service provides tools for story planning, novel generation, character creation, and webcomic generation. These tools leverage artificial intelligence models to help you create written and visual content based on your inputs and creative direction.

Features, functionality, and pricing of the Service are subject to change at any time. We will make reasonable efforts to provide advance notice of material changes that may affect your use of the Service, including changes to pricing or the discontinuation of features.

4. Credits (Sparks)

Sparks are the in-app currency used to pay for generation features within the Service. By purchasing or receiving Sparks, you acknowledge and agree to the following:

• Sparks are non-refundable and have no cash value. They cannot be redeemed for cash, gift cards, or any other form of monetary compensation.
• Sparks do not expire while your account remains active and in good standing.
• Unused Sparks are not transferable between accounts.
• Current Spark costs for generation features are as follows:
  • Novel generation: 10 Sparks per generation
  • Character images: 5 Sparks per image
  • Webcomic storyboard: 5 Sparks per chapter
  • Webcomic panel images: 5 Sparks per panel
  • Cover regeneration: 10 Sparks per regeneration
• We reserve the right to adjust Spark costs for generation features at any time. We will provide reasonable notice before implementing cost changes, and any Sparks already purchased will remain valid at whatever cost structure is in effect at the time of use.

5. Subscriptions

Toonforge offers subscription plans that provide monthly allocations of Sparks and access to additional features. By subscribing, you agree to the following:

• Subscriptions automatically renew at the end of each billing period unless cancelled prior to the renewal date. You will be charged the then-current subscription price at each renewal.
• You may cancel your subscription at any time through the billing portal accessible from your account settings. Cancellation is effective immediately, but your subscription benefits continue until the end of the current billing period.
• No prorated refunds will be issued for partial billing periods. If you cancel mid-cycle, you retain access to subscription benefits for the remainder of the period you have already paid for.
• Monthly Sparks included with your subscription are granted at the start of each billing period. These Sparks are added to your existing balance and do not replace unused Sparks from prior periods.

6. Content Ownership

Ownership and licensing of content created on or submitted to the Service are governed by the following terms:

• You retain full ownership of all text, descriptions, prompts, and other original content you provide to the Service ("Your Inputs").
• AI-generated content, including text and images produced by the Service based on Your Inputs, is provided to you on an as-is basis. You are granted a non-exclusive, perpetual, worldwide license to use, reproduce, modify, distribute, and display AI-generated content for both personal and commercial purposes.
• We make no guarantee of exclusivity for AI-generated content. Due to the nature of AI models, similar prompts provided by different users may produce similar or substantially similar results.
• By publishing content on Toonforge (including making your novels or webcomics publicly accessible), you grant Toonforge a non-exclusive, worldwide, royalty-free license to host, display, cache, and distribute that content on and through the platform, including for promotional purposes related to the Service.
• You may remove your published content from the Service at any time. Removal of published content terminates the display and distribution license granted above, except that cached copies may persist for a reasonable period as part of normal platform operations.

7. AI-Generated Content

The Service uses third-party artificial intelligence models to generate text and images. You acknowledge and agree to the following regarding AI-generated content:

• AI-generated content may contain errors, inaccuracies, inconsistencies, or material that is inappropriate, offensive, or otherwise objectionable. The output of AI models is inherently probabilistic and cannot be fully predicted or controlled.
• You are solely responsible for reviewing, editing, and approving all AI-generated content before publishing it on the platform or using it in any other context.
• We do not guarantee the quality, accuracy, originality, or appropriateness of any AI-generated content. The Service is a tool to assist your creative process, not a replacement for your editorial judgment.
• AI-generated images may not perfectly match your descriptions, expectations, or intended creative vision. Variations in style, composition, and fidelity are inherent to the technology.

8. Acceptable Use

You agree to use the Service in compliance with all applicable laws and regulations. Specifically, you agree NOT to:

• Use the Service to generate content that is illegal under any applicable law, including but not limited to content that infringes intellectual property rights, violates privacy rights, or constitutes fraud.
• Generate content that depicts, promotes, or glorifies the sexualization of minors, child abuse, or the exploitation of children in any form.
• Use the Service to harass, threaten, stalk, intimidate, or defame any individual or entity.
• Attempt to reverse-engineer, decompile, disassemble, or otherwise derive the source code or underlying algorithms of the Service or any AI models used by the Service.
• Scrape, crawl, or use automated means to access, collect data from, or interact with the Service, except through officially provided APIs.
• Circumvent, exploit, or manipulate the Spark credit system, including exploiting bugs, glitches, or vulnerabilities to obtain free or discounted generations.
• Impersonate any person or entity, or falsely represent your affiliation with any person or entity.
• Upload malicious code, viruses, or any other harmful material, or attempt to compromise the security, integrity, or availability of the Service.

9. Content Moderation

Toonforge reserves the right, but is not obligated, to review, monitor, and moderate content published on the platform. In connection with content moderation:

• We may review and remove any content that, in our sole judgment, violates these Terms, is harmful, objectionable, or otherwise inappropriate.
• We may suspend or permanently terminate accounts that repeatedly or egregiously violate our content policies or these Terms.
• We are not obligated to monitor all user-generated or AI-generated content on the platform and assume no liability for content that we have not reviewed.

10. Disclaimers

THE SERVICE IS PROVIDED ON AN "AS-IS" AND "AS AVAILABLE" BASIS, WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

Without limiting the foregoing, Toonforge does not warrant that:

• The Service will be uninterrupted, timely, secure, or error-free.
• AI generation features will always be available, produce satisfactory results, or function without errors or unexpected outputs.
• Any content generated through the Service will be accurate, complete, reliable, or suitable for any particular purpose.
• Defects in the Service will be corrected within any particular timeframe.

You use the Service at your own risk. We are not responsible for the content generated by AI models, and you assume full responsibility for your use of any AI-generated content.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL TOONFORGE, ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION LOSS OF PROFITS, LOSS OF DATA, LOSS OF GOODWILL, BUSINESS INTERRUPTION, OR ANY OTHER INTANGIBLE LOSSES, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF OR INABILITY TO USE THE SERVICE.

Our total aggregate liability to you for all claims arising out of or relating to these Terms or the Service shall not exceed the total amount you paid to Toonforge during the twelve (12) months immediately preceding the event giving rise to the claim. If you have not made any payments to Toonforge, our total liability shall not exceed fifty dollars ($50.00 USD).

12. Indemnification

You agree to indemnify, defend, and hold harmless Toonforge and its officers, directors, employees, agents, and affiliates from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or in connection with: (a) your use of the Service; (b) any content you create, publish, or distribute through the Service; (c) your violation of these Terms; or (d) your violation of any rights of any third party.

13. Changes to Terms

We reserve the right to modify these Terms at any time. When we make material changes, we will notify you by email (if you have provided one) or through a prominent notice within the Service. The updated Terms will indicate the date of the most recent revision.

Your continued use of the Service after any changes to these Terms constitutes your acceptance of the revised Terms. If you do not agree to the modified Terms, you must discontinue your use of the Service.

14. Governing Law & Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to conflict of law principles. Any dispute, controversy, or claim arising out of or relating to these Terms or the Service shall be resolved through binding arbitration administered in accordance with the rules of the American Arbitration Association. The arbitration shall be conducted in English, and the arbitrator's decision shall be final and binding.

You agree that any arbitration shall be conducted on an individual basis and not as a class, consolidated, or representative action. You waive any right to participate in a class action lawsuit or class-wide arbitration against Toonforge.
